POTENTIAL PROFIT CENTERS PROVIDED BY THE SITE AND SOFTWARE - The site and software together provide several potential profit centers and could be extremely profitable in the right hands.

3. SYNDICATE AND/OR CO-BRAND WEBSITE FEATURES - All of the features in the SMART STATS section can be sold individually, or as a co-branded "SMART STATS" or "sports stats" package to other web sites. Potential subscribers would be all sports related web sites, including off-shore sportsbooks and sports sections of newspaper web sites. Again, a new owner could either find a syndication company to represent him or attempt self-syndication.
4. SELL OR LICENSE SOFTWARE - A new owner could package and sell or license the proprietary sports software to either individuals for home use or to hardcopy and web based publications.
5. SUBSCRIPTION FEE - A new owner could charge a subscription fee to access either the site or the site's proprietary Smart Stats.

7. REVIVE AP LAWSUIT - An additional point a potential buyer may want to know about the software.
a) In 1984 the Associated Press (AP) and one of its suppliers, Sports Features Syndicate (has since changed its name), copied the format and statistical columns of ASW's pitching form in sequence.
b) When AP and Sports Features failed to satisfy ASW's complaints of infringement and failed to deliver on promises made to keep ASW from filing suit, ASW retained an attorney in August, 1986.
c) After obtaining copyrights on ASW's software and the various formats the software produces (Pitching Form, Football Form, etc.), ASW's attorney finally filed suit in March 1989. Some time later ASW learned this was 5 months after the statute of limitations had expired.
d) The case and the U.S. Second Circuit Court of Appeals in New York City (90-7469 and 92-7735) upheld the copyrightability of ASW's software and all of the various statistical formats it produces. The Second Circuit also held that AP had infringed on ASW's Pitching Form, but ASW lost the case because its attorney filed the action 5 months after the statute of limitations had expired. According to court papers in 1992, more than $16,000,000 was at stake. The number would be considerably higher today, given that AP continues to sell a derivative version of the original pitching form they copied from ASW as part of its sports agate page package. In owner's opinion, given the misunderstanding by the court regarding several of the facts in the case, the court failing, in owner's view, to properly "toll the statutes due to administrative delay" and with AP continuing to sell the pitching form to nearly all of its major newspapers, one wonders if some creative attorney with a fresh look at the case might be able to devise a legitimate way to re-open it.
SPORTS SOFTWARE - Some details about the software.
1. The sports software computer code for each sport - baseball, football (college and pro), basketball (college and pro), today's line/latest line and formatting (EN's/EM's) - is currently written in C BASIC, and operates in DOS and/or in a DOS window. The data entry programs, which maintain the data base files for each sport, are DOS based. The data base files are updated daily in season and uploaded to the web site.
2. The software creates and maintains the data bases and produces, not only the various hardcopy sports features which were syndicated to newspapers over the years ("Today's Pitching Form", "Today's NBA Form", "This Week's College Football Form", "This Week's NFL Football Form" and "Today's Line"), but also the entire "SMART STATS" section of the web site, including the four static pages and all seven dynamic, visitor driven data base pages. It can also produce a variety of other interesting charts and forms for the various sports, which have never been made available for newspaper syndication or for viewing on the web site.
3. Certain portions of the output programs which produce some of the copyrighted formats and statistical forms have been re-written in Perl, so they can operate interactively on the internet. These re-written portions of programs are able to read the data base files produced by the DOS based data entry programs (see the SMART STATS section of the web site).

1. In addition to NBA data, the basketball software is also capable of managing college basketball data and of producing college basketball forms like those it generates for the NBA.
